| Resumen : | La tesina titulada “El Alcance del artículo 42 del Tratado de Creación del Tribunal de Justicia de la Comunidad Andina ante la firma de tratados bilaterales o multilaterales por parte de uno o varios países miembros de la Comunidad Andina”, constituye un trabajo de investigación alentado por la necesidad de dimensionar los efectos de la suscripción de varios Tratados de Comercio Bilaterales entre Países Miembros de la Comunidad Andina y los Estados Unidos de Norteamérica. Específicamente, el presente trabajo de investigación aborda el complejo tema relacionado con el análisis del alcance del artículo 42 del Tratado de Creación del Tribunal Andino de Justicia que consagra su jurisdicción de naturaleza privativa y exclusiva respecto a la solución de las controversias surgidas sobre materias reguladas por el derecho comunitario, y el impacto de la posible superposición de compromisos comerciales derivados de la adopción de tratados de carácter multilateral o bilateral con terceros países. |
| Descripción : | The research work under the title of "The Reach of Article 42 of the Treaty Creating the Court of Justice of the Cartagena Agreement before the signature of bilateral or multilateral treaties by part of one or several States members of the Andean Community", constitutes an investigative effort encouraged by the necessity of understanding the effects of the subscription of several Bilateral Treaties of Trade between Countries Members of the Andean Community and the United States of North America. Specifically, this investigation work studies the reach of the article 42 of the Treaty Creating the Court of Justice of the Cartagena Agreement that consecrates the exclusive jurisdiction of the Court of Justice of the Andean Community in the solution of any disputes that may arise from the application of the provisions comprising the legal system of the Andean Community and the impact of the possible overlapping of jurisdictions derived by the adoption of bilateral or multilateral treaties by the States that may contain parallel obligations to the Andean legal system provoking an institutional danger that a same dispute could be brought before two different dispute settlement systems. |
