Sometimes, such behavior is misinterpreted as a mere civil malice, resulting not in a criminal offense, but in a breach of contract. dc.description.abstractEl delito de abuso de confianza es un injusto penal donde se requiere que el sujeto activo actue con un comportamiento doloso de índole penal, ocasionando un detrimento patrimonial hacia el sujeto pasivo. En ocasiones, dicho comportamiento es malinterpretado con un mero dolo civil, resultando no en un tipo penal, sino en un incumplimiento contractual.
